August 16, 2010
8-2-2010 (324) amending the Code of Ordinances of the City of Altoona, Iowa, 2004, by amending chapter 69.13 no parking on north side of street, except along 4th Street NW from 17th Avenue NW to 14th Avenue
This is the second reading to allow parking on the north side of 4th Street NW from 17th Avenue NW, east to 14th Avenue NW.

8-2-2010 (323) amending the Code of Ordinances of the City of Altoona, Iowa,
2004, by amending chapter 69.08 no parking zones on the south side of 4th Street
NW from 17th Avenue NW to the east side of the 14th avenue NW intersection
The changes are to improve the parking adjacent to Village Park, which is located north of 4th Street NW and east of 17th Avenue NW. Parking is permitted on the north side of 4th Street NW from 17th Avenue NW, east to 14th Avenue NW.

6-7-2010 (320) amending the Code of Ordinances of the City of Altoona, Iowa, 2004, by
amending provisions pertaining to fat, oil and grease discharge by food service
establishments
The WRA is requiring all member communities to amend their Code of Ordinances for the
regulation of Fat, Oil and Grease Discharge by Food Establishments. The changes simplify
grease interceptor sizing, clarify the procedures for obtaining exceptions for economic hardship,
allow installation of 5,000 gallon interceptor tanks which are now available in the metropolitan
area and correct ambiguities in the ordinance previously passed by the WRA Board in December
2005.

5-17-2010 (321) amending the Code of Ordinances of the City of Altoona, Iowa, 2004, by
creating a stormwater utility ordinance
The purpose of the ordinance is to establish a stormwater utility to be responsible for stormwater
management within the City of Altoona. This ordinance does not set or establish rates for the
utility. A separate ordinance will be created (similar to how the water and sanitary sewer rates are
set), to set the stormwater utility rates. Staff and our consultant worked with a Resource Group
made up of local residents, businesses and a council member to establish the content of the
ordinance.

amending Chapter 92

1-18-2010 (317) approve amending the Code of Ordinances of the City of Altoona, Iowa,
2004, by amending Chapter 92, section 02 (Water Rates)
This ordinance increases the water rate per 1000 gallons from $5.18 to $5.78 effective February
1, 2010. This increase was planned to cover the costs for the capitals projects.

1-18-2010 (318) approve amending the Code of Ordinance of the City of Altoona, Iowa,
2004, by amending chapter 98, section 10 (Sewer Rates)
This ordinance increases the sewer rate per 1000 gallons from $5.13 to $6.36 effective February
1, 2010. This increase was planned to cover the costs for capital projects.

9-21-2009 (309) approve a new zoning district – C-7 regional commercial
This ordinance approves the new C-7 Regional Commercial ordinance.

11-2-2009 (314) amending the Code of Ordinances of the City of Altoona, Iowa, 2004 to
rezone approximately 173.4 acres from A-1 (agricultural) to C-7 (regional commercial)
This ordinance approves the rezoning of 173.4 acres from A-1 (Agricultural) to C-7 (Regional
Commercial). The property is owned by Prairie Crossing Investment, Incorporated.

11-2-2009 (315) amending the Code of Ordinances of the City of Altoona, Iowa, 2004 by
amending the architectural design standards (Chapter 171.01.2.k. (3)) to include the C-7
district in the list of commercial districts
This ordinance adds “C-7” to the list of all the other commercial districts that are applicable to the
architectural design standards. Buildings within a C-7 zoning district will have to meet at a
minimum the same building and architectural material standards as any other commercial
building.

11-2-2009 (316) amending the code of ordinances of the city of altoona, iowa, 2004 by amending chapter 167 – zoning code general regulations
This is an ordinance amendment regarding swimming pools and hot tubs. This amendment better defines the enclosure as a barrier rather than a fence. This will allow other materials to be utilized to create the enclosure around the swimming pool. The amendment also allows that hot tubs will be exempt from the barrier requirement, provided the hot tub utilizes a cover that meets the ASTM F1346-91 standards.

This is an ordinance amendment to the Mechanical Code ordinance. The amendment revises our licensing regulations so that we are in compliance with the adopted State Laws.

2004 by amending Chapter 157 – Plumbing Code
This is an ordinance amendment to the Plumbing Code ordinance. The amendment revises our
licensing regulations so that we are in compliance with the adopted State Laws.

2004 by amending Chapter 158 – Electrical Code
This is an ordinance amendment to the Electrical Code ordinance. The amendment revises our

2004 by amending chapter 160 – Contractor Licensing

9-21-2009 (308) amendment to the Code of Ordinances of the City of Altoona, Iowa, 2004, by adding a new paragraph in Chapter 65, Section 02
This ordinance adds stop signs on 34th Avenue NW to stop north bound and south bound traffic. This will now be a four-way stop.

8-17-2009 (306) to amend the Code of Ordinances of the City of Altoona, Iowa, 2004, by adding a new paragraph in Chapter 65, Section 02
The amendment is for the placement of a stop sign at the intersection of Fifth Avenue SW and Third Street SW, for vehicles traveling on Fifth Avenue SW.

8-17-2009 (307) to amend the Code of Ordinances of the City of Altoona, Iowa, 2004, by modifying an existing paragraph in Chapter 65, Section 02
The amendment is for the placement of a stop sign at the intersection of Seventh Avenue SE and Eleventh Street SE, for vehicles traveling on Seventh Avenue SE.

6-15-2009 (304) amendment to the Code of Ordinances of the City of Altoona, Iowa, 2004, by amending Chapter 23.02, term of office for planning and zoning board
This amendment addresses the attendance requirement for the Planning and Zoning Commission. The language in the amendment is same as that of the Park Board. Members will be allowed to (2) unexcused absences, or (3) total absences from regularly scheduled meetings in any one calendar year. Failure to comply will be grounds for dismissal.

6-15-2009 (305) amendment to the Code of Ordinance of the City of Altoona, Iowa, 2004, by
amending Chapter 170.01, board created for Board of Adjustment

5-18-2009 (303) amendment to the Code of Ordinances of the City of Altoona, Iowa, 2004
by adding a new chapter pertaining to inspections of residential rental properties
This amendment adds Chapter 162 pertaining to the inspections of residential property. The
provisions of this ordinance shall apply to all residential rental properties and their related
accessory structures. These provisions shall constitute minimum requirements and standards for
premises, structures, equipment, and facilities for light, ventilation, space, heating, sanitation,
protection from the elements, life safety from fire and other hazards, and for safe and sanitary
maintenance.

5-4-2009 (302) amendment to Chapter 92 of the City of Altoona Code of Ordinances (water deposit)
The City is looking to increase the deposit amount from $50.00 to $100.00. This deposit is for your utility bill that includes: water, sewer, irrigation, recycling and garbage. With the increase in fees in all of these areas the $50.00 amount does not cover an average homes monthly utility bill. By increasing the deposit amount, the City will spend less time trying to recover payment for utility bills for people who move out of Altoona.

4-6-2009 (301) amendment to Chapter 63 to set the 35 mph speed zone for 24th Street SW
from 1st Avenue South to the western limits of the street
This ordinance set the speed limit on our new stretch of 24th Street SW.

3-16-2009 (300) establish the North I-80 sanitary sewer connection fee district and to adopt the connection fee
From the effective date of June 30, 2009, a connection fee of $2,600 per acre of property served
by the sewer facilities shall be imposed. Thereafter, the per-acre connection fee shall be annually
adjusted as of July 1, of each year according to the schedule provided in the ordinance.

2-2-2009 (299) amendment to rezone Daso Coatings property at 295 9th Street NE from C-2 (General Commercial) to conditional M-1 (Limited Industrial)

1-5-2009 (297) amendment to Chapter 69.08 no parking zones to clarify language for parking on 8th Avenue SE
This amendment to Chapter 69.08, No Parking Zones clarifies that there is no parking on 8th Avenue SE, on either side of the street, from 1st Street East to 8th Street SE. This is the stretch of 8th Avenue SE that is adjacent to the youth complex.

01-05-2009 (298) amendment to Chapter 69.08 no parking zones to add no parking on Adventureland Drive NW and Adventureland Drive NE
This amendment is for house keeping purposes. The current ordinance still refers to Adventureland Drive as 9th Street NW and NE. The amendment will correctly identify this street and prohibit parking on Adventureland Drive NW and Adventureland Drive NE, on either side, within the City Limits. The portion of old Adventureland Drive that has been renamed 9th Street NW and 9th Street NE, is covered on the general provision of the ordinance that prohibits parking on the north side of streets within the City Limits.

The amendment increases the water rate per 1000 gallons from $4.78 to $5.18 effective January 1, 2009.

12-15-2008 (295) amendment to the Code of Ordinance of the City of Altoona, Iowa, 2004, by amending Chapter 98, Section 10
The amendment increases the sewer rate per 1000 gallons from $ 4.73 to $ 5.13 effective January 1, 2009.

12-15-2008 (296) amendment to rezone Casey's at 407 8th Street SW from C-1 (Transitional Commercial) to C-2 (General Commercial)
The correct zoning for a convenience store is C-2 and this will get the property into compliance with zoning regulations.

11-17-2008 (293) amendment to ordinance Chapter 171.01.2.k to add 50% brick or stone requirement for other permitted uses in residential zoning districts
This amendment is clearly state the Architectural Design Standards. Non-residential structures
should be required to incorporate 50% brick, stone, or “architecturally designed” concrete tilt-up
panels, similarly to multiple family structures in R-3 and R-5 districts.

11-3-2008 (291) amendment to ordinance Chapter 155.22 (Accessory Structures)
The amendment to the building code ordinance states this ordinance would allow residential
accessory structures to be built without Frost Protected footings for sizes up to 1,000 square feet.
Currently, the ordinance only allows for structures up to 720 square feet to be built without Frost
Protected footings. The recommendation to amend this ordinance is based on current
technologies and testing that has improved the safety of these sized structures.

11-3-2008 (292) to approve adoption Chapter 148 - Post Construction Storm Water Management
The adoption of Ordinance Chapter 148 states the U.S. EPA's National Pollutant Discharge
Elimination System (NPDES) permit program administered by the Iowa Dept. of Natural
Resources requires that the City of Altoona obtain a MS4 permit for the discharge of storm water
from a Municipal Separate Storm Sewer System. This amendment is to comply with the MS4
Permit requirements and establish a set of water quality and quantity policies to all surface waters
to provide reasonable guidance for the regulation of storm water runoff.

10-20-2008 (290) amendment for approximately 1.2 acres of ground at 907 8th Street SW to
rezone from R-2 (One and Two-family residential) to C-2 (General Commercial)
The property is owned by Jantor, Inc. and is operated as 8th Street Childcare. The request to
rezone is brought forward by the owner out of their desire for a new sign. They are requesting
that the zoning be changed from its current R-2 (One and Two-family Residential) to C-2 (General
Commercial). The property is currently a non-conforming use and will remain a non-conforming
use under the zoning change. The designated zoning for daycare centers is R-3 (Multi-family
Residential).

This amended ordinance section 57.08 which has been replaced with the model ordinance
recommended by the Metro Advisory Council.

9-15-2008 (286) amendment to Chapter 63 for a 25 mph speed limit on Center Place SW
This adds Center Place SW from 8th Street SW to 5th Avenue SW, to Chapter 63 of the Code
of Ordinances

9-15-2008 (287) amendment to Chapter 63 to create a special 30 mph speed zone for 11th Avenue NE
This is the new street constructed to serve the Merchants Warehouse and the rail spur.

9-15-2008 (288) amendment to Chapter 65 stop signs to place stop signs at existing intersections, mainly throughout the SE and SW quadrants of the city
This amendment adds 80 plus stop signs throughout the city. These locations are in newer subdivisions where we have received numerous inquires as to the need for stop signs. These affected locations were originally planned to be uncontrolled intersections, which would require drivers to yield the right of way to on coming traffic.

8-18-2008 (285) to amend Chapter 168.13.3 permitted conditional uses in the M-1 district
This ordinance adds a permitted conditional use to the M-1 (Limited Industrial) district. It would
allow indoor sports and recreation facilities as a permitted conditional use. The permitted
conditional use criteria would require an interested party to present an application to the Board of
Adjustment for their review and consideration.

8-4-2008 (283) to rezone 27.88 acres at 3801 Adventureland Drive NW from A-1 to C-3
This ordinance rezones the property from A-1 (Agricultural) to C-3 (Planned Commercial).

7-21-2008 (282) to amend Chapter 167.02 fences, walls and hedges
This ordinance amends the most recent change to Chapter 167.02 Fences, Walls, and Hedges,
section of the Zoning Ordinance. This change also deals with six-foot tall privacy fences on a
corner lots that abuts major streets. The major streets are listed in the ordinance in Section (1)
paragraph (7). The landscaping requirements of subsection (6) below apply to the area between
the fence and right-of-way along the major street or highway for the length of fence.

6-16-2008 (281) to amend Chapter 167.02 fences, walls and hedges
This amendment adds language to allow a six-foot tall privacy fence on a corner lot that abuts a major street or highway and abuts “through” lots (also called double frontage lots). As written, the fence would only extend to the rear line of the home and would also have to comply with the landscaping requirements of the through lots.

The main changes deal with adding language that makes it clear that 1 & 2 family dwellings in R

easements instead of three feet away as is now the case.

This ordinance adds a new paragraph to Chapter 69, Section 08, No parking Zones. The
amendment would prohibit parking on the south side of 9th Street SE, from 7th Avenue SE, to a
point 75 feet east. The no-parking zone is near Centennial Elementary.

The amendment removes the actual verbiage from the ordinance that lists examples of cases and refers the user to the actual building code section for reference.

2-18-2008 (277) an ordinance to approve amendment to chapter 169.05 expiration of permit
The admendment removes the references to the language used under the Uniformed Building
Code and replaces it with the references to the International Building Code.
