On June 15, 2009, the City of Altoona Council passed a Residential Rental Property Ordinance. This ordinance creates and establishes a Department of Housing in the City and allows for staff to conduct inspections of all rental properties in accordance with the 2006 International Property Maintenance Code, including amendments. With this being a new program for the community there will be some unexpected obstacles and unforeseen situations that will be brought to our attention. The Department intends to work with property owners on any issues and challenges that may arise however we must still ensure that a safe and livable environment is being maintained for all occupants. The ordinance is two-folded in its approach. The provisions enacted immediately upon the adoption are administrative; create the department, allow us to send out notifications, applications and other items. The second phase of the Ordinance will come into effect on January 1, 2010. These provisions will allow us to actually conduct inspections of properties to verify compliance. Upon a successful inspection the property will be issued a Certificate of Compliance. No property owner will be allowed to rent without obtaining this Certificate. This second phase also allows for penalties and legal recourse for those properties that do not comply with the adopted provisions. NOTE: If the rental housing application and fee has been received by the Department of Housing no later than December 31, 2009 then said property owner may continue to rent until such time said property has received a valid certificate, which then must be maintained. TENANTS: If choosing to lodge a concern or complaint with this office against a property owner then the Complaint Request form must be submitted prior to staff conducting an investigation. If upon inspection it is found that a deficiency exists due to the actions of the tenant then said tenant will be charged for the inspection fee. This office will not resolve any cosmetic or personality disputes. Applications
